Frequently Asked

What are the consequences of a first-offense DUI in Arizona?

A first-offense DUI in Arizona under A.R.S. § 28-1381 carries:

  • Mandatory jail — minimum 24 hours, with up to 10 days suspendable via home detention or interlock-eligibility
  • License suspension — 90 days administrative for a failed breath test (1 year for refusal)
  • Ignition interlock — 12 months on Regular DUI; longer on Extreme
  • Fines and assessments — typically $1,500–$2,500 range
  • Permanent criminal record — Arizona does not expunge DUI
  • Collateral consequences — insurance, employment, security clearance, professional license, immigration

Extreme DUI (BAC ≥ 0.15) and Aggravated DUI carry substantially heavier mandatory minimums. See Arizona DUI penalties for the full picture.
