Phoenix DUI process — the 30-day clock

Whether your stop was within Phoenix city limits or on a nearby freeway, the Arizona MVD process is the same:

  1. At the stop: Notice of Suspension issued (the pink form).
  2. Within 30 days: Request the MVD hearing under A.R.S. § 28-1385(G)(2)(c). Miss it and the suspension runs automatically — 90 days for a failed test, one year for a refusal.
  3. MVD hearing: The defense can challenge the lawfulness of the stop, the validity of the test, and the affidavit content.
  4. Criminal case proceeds separately in Phoenix Municipal Court (or Superior Court if felony).
