Scottsdale DUI process — the 30-day clock
Whether your stop was within Scottsdale city limits or on a nearby freeway, the Arizona MVD process is the same:
- At the stop: Notice of Suspension issued (the pink form).
- Within 30 days: Request the MVD hearing under A.R.S. § 28-1385(G)(2)(c). Miss it and the suspension runs automatically — 90 days for a failed test, one year for a refusal.
- MVD hearing: The defense can challenge the lawfulness of the stop, the validity of the test, and the affidavit content.
- Criminal case proceeds separately in Scottsdale City Court (or Superior Court if felony).
